Terms & Conditions

1. About Us

This website is operated by Church & Hill Ltd ("Church & Hill", "we", "us" or "our").

Church & Hill Ltd is a company registered in England and Wales under company number 17491567.

Our registered office is: Church & Hill LTD
6 County Business Park
Northallerton
DL6 2NQ.

These Terms & Conditions govern your use of our website and any purchases you make through it. By using our website or placing an order, you agree to these terms. Please read them carefully before making a purchase.

Nothing in these terms affects your statutory rights as a consumer.

2. Our Products

Church & Hill creates premium garments inspired by British heritage and South American craftsmanship, including ruanas, ponchos and other clothing and accessories.

We take reasonable care to ensure that product descriptions, images, colours and prices are accurate. However, colours may appear slightly different depending on your screen, device settings and lighting conditions.

Our garments may be made using natural fibres and traditional weaving techniques. Minor variations in colour, texture, weave and finish may occur as a natural characteristic of these materials and processes. Such variations do not automatically constitute a fault.

Where a product has specific characteristics, materials or care requirements, these will be described on the relevant product page.

All products are subject to availability. We reserve the right to discontinue products or make reasonable changes to our product range.

3. Prices and Payment

All prices displayed on our website are in pounds sterling (GBP), unless otherwise stated.

Any applicable UK VAT is included in the displayed price where required by law. Delivery charges and any other applicable charges will be clearly displayed before you complete your purchase.

We accept the payment methods displayed at checkout. Payment must be authorised and completed before an order can be processed, unless otherwise agreed.

We take reasonable care to ensure that prices are accurate. If we discover an obvious pricing error before accepting your order, we will contact you to explain the issue and give you the option to proceed at the correct price or cancel your order for a full refund.

Promotional offers and discounts may be subject to specific terms, which will be displayed when the offer is made. Unless expressly stated otherwise, promotions cannot be combined.

4. Orders and Contract Formation

When you place an order through our website, you are making an offer to purchase the selected products.

You will receive an order confirmation by email acknowledging receipt of your order. This acknowledgement does not necessarily mean that your order has been accepted.

A contract between you and Church & Hill Ltd is formed when we confirm that your order has been accepted, normally through an order confirmation or dispatch notification.

We reserve the right to decline or cancel an order where there is a legitimate reason, including product unavailability, an obvious pricing error, a payment authorisation failure or a suspected fraudulent transaction.

If we cancel an order after payment has been taken, we will refund the amount paid for the cancelled order using the original payment method.

Please ensure that your delivery address, contact details and order selections are correct before completing your purchase. If you notice an error, contact us as soon as possible. We will do our best to assist, although we cannot guarantee that changes can be made once an order has been processed or dispatched.

5. Delivery

We aim to process and dispatch orders within the timeframes stated on our website.

Available delivery methods, estimated delivery times and applicable charges will be displayed at checkout or explained in our Shipping Policy.

Delivery times are estimates unless we have expressly agreed otherwise. If a delivery is delayed, we will work with you to resolve the issue in accordance with applicable law.

Unless otherwise agreed, goods must be delivered without undue delay and, in any event, within 30 days of the contract being made.

Responsibility for the goods remains with us until they come into your physical possession, or the possession of someone you have identified to receive them, unless you independently arrange a carrier not offered by us.

For further information about delivery arrangements, please refer to our Shipping Policy.

6. Returns, Cancellations and Refunds

We want you to be happy with your purchase.

For eligible online purchases, UK consumers generally have the right to cancel their order within 14 days of receiving the goods, without giving a reason. You then have a further 14 days to return the goods after notifying us of your cancellation.

Returned items should be handled with reasonable care. You may inspect a garment as you would reasonably be permitted to do in a shop. We may be entitled to deduct an amount for diminished value where goods have been handled beyond what is necessary to establish their nature, characteristics and functioning.

Unless we have agreed otherwise or the law requires us to cover the cost, you are responsible for the direct cost of returning goods when exercising your right to cancel.

Refunds will be made in accordance with applicable law and our Returns Policy. Where a statutory cancellation applies, refunds will generally include the cost of our least expensive standard delivery option, where applicable.

Different rules may apply to certain goods, including genuinely personalised or made-to-order items where a legal exception applies. Any applicable exception will be explained before purchase. The mere fact that a garment is handmade or produced in a limited run does not, by itself, remove your cancellation rights.

Your rights concerning faulty, damaged or misdescribed goods remain unaffected. Nothing in this section limits any rights you have under the Consumer Rights Act 2015 or other applicable consumer protection legislation.

Please consult our Returns & Refunds Policy for full details of the return process, cancellation procedure and refund arrangements.

7. Product Quality and Statutory Rights

We take care in selecting our materials and presenting our products. However, natural fibres and traditional weaving techniques can produce minor variations between individual garments.

All products supplied to consumers must meet the requirements of applicable law, including being of satisfactory quality, fit for their usual purpose and as described.

If you receive an item that is faulty, damaged or not as described, please contact us with your order details and a description of the problem. Photographs may help us assess the issue, where appropriate.

We will consider the matter in accordance with your statutory rights and the remedies available under applicable law.

Our care instructions should be followed to help maintain the quality and longevity of your garment. However, following care instructions does not affect your statutory rights if a product is faulty or otherwise fails to meet legal requirements.

8. Intellectual Property

All intellectual property rights in our website and its contents, including our brand name, logos, crests, product designs, photography, written content, graphics and other materials, belong to Church & Hill Ltd or our relevant licensors, unless otherwise stated.

Our brand draws on British and South American heritage, craftsmanship and materials. Our website content and brand assets have been developed to represent our identity and products.

You may view and use our website for your personal, non-commercial purposes.

You must not reproduce, distribute, modify, publish, commercially exploit or otherwise use our website content or brand assets without our prior written permission, except where permitted by law.

Nothing in these terms transfers any intellectual property rights to you.

9. Website Use

You agree to use our website lawfully and not to engage in any activity that could damage, disrupt or interfere with its operation, security or availability.

You must not attempt to gain unauthorised access to our website, its servers or related systems, introduce malicious software, or use our website for fraudulent or unlawful purposes.

We aim to keep our website available and accurate, but we cannot guarantee uninterrupted access or that all content will always be free from errors.

We may update, suspend or modify parts of our website where reasonably necessary, including for maintenance, security, operational or commercial reasons.

10. Liability

Nothing in these terms excludes or limits liability where doing so would be unlawful.

In particular, nothing in these terms limits our liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or restricted.

Subject to the above, we will not be responsible for losses that were not reasonably foreseeable when the contract was formed, or for losses arising from use of our website that is unrelated to a purchase, to the extent permitted by law.

We are not responsible for delays or failures caused by events beyond our reasonable control, such as severe weather, transport disruption, natural disasters, strikes, interruptions to essential services or other events that could not reasonably have been prevented.

Where such an event affects an order, we will take reasonable steps to minimise the impact and communicate with you where appropriate. This clause does not remove any cancellation, refund or other rights you may have under applicable law.

11. Third-Party Websites and Services

Our website may contain links to third-party websites or use third-party services, including payment processors and delivery providers.

These third parties may operate under their own terms and privacy policies. We are not responsible for the content or privacy practices of independent third-party websites.

This does not affect our responsibilities to you in relation to purchases made through our website.

12. Privacy and Personal Information

We process personal information in accordance with our Privacy Policy and applicable data protection legislation.

Personal information may be used to process orders, arrange deliveries, provide customer support, meet legal obligations and, where permitted, communicate relevant marketing information.

Please read our Privacy Policy for further information about how we collect, use, store and protect your personal information and the rights available to you.

13. Changes to These Terms

We may update these Terms & Conditions from time to time to reflect changes to our business, products, website or applicable legal requirements.

The latest version will be published on our website with the date of the most recent update.

Changes will not retrospectively alter an existing contract unless required by law or agreed with you. The terms applicable to your order will be those agreed when your contract was formed.

14. Governing Law

These Terms & Conditions are governed by the laws of England and Wales, subject to any mandatory consumer protection provisions that apply in your place of residence.

If you are a consumer, you may also have the right to bring proceedings in the courts of the part of the United Kingdom in which you live, where applicable.

We encourage customers to contact us first if they have a concern or complaint so that we can try to resolve it promptly and fairly.
